Dhaka, May 2 The first war crimes tribunal deferred Jamaat guru Ghulam Azam's indictment order for a second time on Wednesday and fixed May 13 the new date.

Scheduled for wednesday, the three-judge tribunal, headed by Justice Mohammad Nizamul Huq, has not yet been able to complete the order to its satisfaction and fixed May 13 when it would rule on whether to indict the former chief of Jamaat-e-Islami or not.

The tribunal however, rejected the 89-year-old Jamaat leader's petition to modify a previous order that allowed Azam to have home cooked food in jail.

Set up to deal with crimes committed during the 1971 Liberation War, the International Crimes Tribunal – 1, said in its order that as far as the court understood the arguments of the defence, it was not ready to accept that Azam's family members would have to bear the risk of any complications arising from food.

The petition had sought that some of the tribunal's conditions be deleted from the order. It was the position of the defence that the home cooked food could well be contaminated when the jail authority examined it or after the family members handed over the food to the jail authorities.

As a result Ghulam Azam's son, Abdullah Aaman Azmi, who could have availed of the court's allowance through an undertaking accepting the court's conditions, did not proceed.

Justice Huq giving the order said it appeared that Azam was still being given jail food. However, the order noted, there was no such evidence before the court that Ghulam Azam's health has deteriorated, as a result.

The order reasoned that since it was the family providing home cooked food to Azam, it would have to shoulder the responsibility too.

Justice Huq had stipulated in his order of Mar 6 that Ghulam Azam's family could supply him home cooked food as they had petitioned but at their "own risk".

The order also stated that no questions could be raised against the jail or hospital authorities if Azam's health deteriorated on account of the food.

Abdur Razzaq, the senior counsel for Jamaat leaders argued that these conditions be deleted from the order.

The order went on to say that the court saw no reason to delete portions of the earlier order, neither were there any new grounds to deviate from its earlier position.

As such the petition is rejected, said the tribunal chairman.

This was promptly followed by another Jamaat counsel taking the podium to inform the court that the jail authorities had taken away the writing pad that the lawyers had provided him for taking notes after having read the prosecution documents.

Justice Huq appeared to be at a loss for words. "Well what can I say to that? We have known that people even write novels in prisons."

He then directed the prosecution to find out what had happed and directed them to order the prison authorities not to repeat the incident.

On Dec 12, 2011, the prosecution brought a 52-point charter of charges against Azam and appealed for his arrest. Later, following the tribunal order, charges were re-arranged and presented to the tribunal on Jan 5, 2012.

He was produced before the tribunal by its order on Jan 11 and sent to jail on the same day. Since that evening Ghulam Azam has been shifted to the prison cell of the Bangabandhu medical university for better treatment considering his delicate health.

Azam had allegedly lead the infamous 'peace committees' and collaborated with the Pakistan Army during the Liberation War. He also spoke in favour of Pakistan to the Middle Eastern countries during the war, according to the prosecution.

He stayed in London for seven years after 1971 and returned to Bangladesh in 1978 during Ziaur Rahman's rule. Having led Jamaat for long, Azam retired from active politics in 1999.

The second of part of Azam's formal charges were presented before the court on Feb 27 as video clippings. The prosecution re-read parts of the formal charge on Mar 6 when it was scheduled to present further arguments. 

Unite to Win next Election Hasina Urges AL Leaders Workers

Prime Minister Sheikh Hasina yesterday urged her party leaders and workers to uphold unity among themselves so that Awami League could win the next general election and thus serve people again.
“You need to keep in mind that we will have to win the next general election and serve people,” she said while addressing a views exchange meeting with the district AL leaders and workers at Bahubal in Rashidpur.
Organised by Habiganj district unit AL, the meeting was held with district AL President Dr Mushfique Hossain Chowdhury in the chair.
Hasina asked her party leaders and workers to project the implemented and ongoing development activities taken by the present government among the masses.
Turning to BNP rule, she alleged that whenever the party came to power, it resorted to looting and embezzlement of money, even of the orphanage.
“They (BNP) did not have time to think about people as they were busy with these works (irregularities),” she said, adding that AL only assumes power to serve people.
Referring to the by-polls in Habiganj where the ruling party lost its seat, Hasina told her party leaders and workers that they would not have to face the disgrace of defeat had they sincerely worked for people. “We will have to work together in the coming days.”
Blaming the BNP-Jamaat alliance for turning the county into one of killing, extremism and terrorism, she said, “In the last three years, we have been able to remove that bad reputation and brighten the country's image.”
Listing various development activities taken by the present government, Hasina said the country has neared self-sufficiency in food production and witnessed bumper production of crops for three consecutive years. “We hope to achieve self-sufficiency in food by 2013.”
Mentioning her government's steps to overcome the power and gas crises, she said some 3,300 MW of power has been added to the national grid over the last three years. “We want the country to be developed fast so that we can stand on our own feet.”
Citing that some 5,175 various elections were held under the present government, she said no one could bring any allegation regarding the polls. “The voting rights are the constitutional rights of the people and such peaceful elections were never held in the past.”
The prime minister said her government always works for ensuring the welfare of people and mentioned various activities like providing free textbooks, forming education-assistance funds and giving the highest facilities to farmers.
Hasina also expressed her strong commitment to build an educated nation. “We want our children to become educated…we want to turn the country into a middle-income one by 2021.”
She also renewed her pledge to build a “Sonar Bangla” as dreamt by Father of the Nation Bangabandhu Sheikh Mujibur Rahman.
Turning to the recent maritime boundary verdict in the case against Myanmar, she expressed hope that Bangladesh's claim would be upheld in the debate over the maritime boundary with India in 2014.
She also assured the workers of tea estates of the area of resolving their problems.
The prime minister also inaugurated Rashidpur Condensate Fractionation Plant (2nd phase) at Bahubal.
Finance Minister AMA Muhith, Social Welfare Minister Enamul Hoque Mostofa Shaheed, AL Organising Secretary Advocate Mesbahuddin Siraj, lawmaker Advocate Abdul Mazid Khan, the upazila Chairman Abdul Kader Chowdhury, Bahubal upazila AL President Nazmul Hossain Chowdury and Petrobangla Chairman Dr Hossain Monsur also spoke on the occasion.

Fast-unto-death at JAHANGIRNAGAR UNIVERSITY One Admitted to Hospital

JAHANGIRNAGAR UNIVERSITY : One of the four Jahangirnagar University students fell sick and admitted to hospital during staging their fast-unto-death on Wednesday for the second consecutive day.

Secretary of Jahangir Nagar Theater Russell Rana was rushed to Savar Enam Medical College Hospital at about 1:30pm as per doctor’s advice.

Earlier in the day, teachers of Jahangirnagar University under the banner of “Shikkhak Samaj” joined the fast-unto-death programme of the general students.

The JU students are continuing their fast-unto-death for the second consecutive day on Wednesday demanding the resignation of Vice Chancellor Professor Shariff Enamul Kabir.

Two teachers on behalf of Shikkhak Samaj – Soma Momtaz and Shamima Sultana –joined the students; demo at about 10am.

Students under banner of ‘Sangskritik Jote and JU against terrorism’ began the fast-till-death at 11:30am on Tuesday in front of residence of VC protesting the attack on cultural workers of the university.

Besides, Editor of the daily New Age Nurul Kabir, Columnist Rehnuma Ahmed, Professor Geeti Ara Safia, singer Krisna Koli, actress Banya Mirza and other noted personalities have expressed their solidarity with the demonstrating students.

Earlier, Bangladesh Chhatra League (BCL) activists of the university unit beat up two followers of Sangskritik Jote on April 28.

A portion of JU teachers under banner of ‘Shikkhak Samaj’ are staging demonstration from April 27 in front of the vice-chancellor`s residence, demanding the resignation of the VC.

BNP to stage demos Sunday

BNP will stage countrywide demonstrations on Sunday to mount pressure on the government to trace its missing leader M Ilias Ali.

The main opposition party will announce its next course of agitation programmes from the demonstrations.

BNP standing committee member Moudud Ahmed made the announcement while addressing a protest rally in front of Nayapaltan head office in the capital.

Moudud condemned the cases against their two leaders, LDP president and several activists of the 18-party alliance for their alleged role in violence during Sunday’s hartal.

“The government is committing crimes one after another; it is only a matter of time before they (govt) fall down", he said.

Demanding immediate withdrawal of the cases, Moudud added, “Filing cases is not going to weaken BNP’s protest. The government will fall down through the movement.”

Judge Embarrassed to Hear BNP Men's Bail Pleas

A High Court judge on Wednesday felt embarrassed to hear the bail petitions of 27 BNP men including party acting secretary general Mirza Fakhrul Islam Alamgir in connection with two cases filed for violence during Sunday's hartal hours.

Justice AKM Shahidul Huq, the junior judge of a division bench of the HC led-by Justice M Siddiqur Rahman Mia, felt embarrassed but did not mention any reason behind his feeling embarrassed.

Earlier, both the judges refused to accept the petitions for hearing since those were not enlisted in the cause list for Wednesday.

Later, Justice M Siddiqur Rahman Mia asked the defence lawyers to move the petitions before this bench on May 6 after enlisting the petitions in its cause list.

As the bench refused to hear the petitions, the pro-BNP lawyers moved the petitions before another HC bench comprising Justice M Enayetur Rahim and Justice Sheikh Md Zakir Hossain.

This bench also expressed inability to hear the petitions since it has no jurisdiction to hear any bail petition.

Twenty-seven accused leaders and workers of the main opposition BNP submitted two separate bail petitions Wednesday morning, two days after the cases were filed against him.

Police filed the cases with Shahbagh and Tejgaon police stations late Sunday in connection with Sunday's violence during hartal hours.

Prime Minister Sheikh Hasina Talks With The Family Members of Missing BNP Leader M Ilias Ali

Tahsina Rushdir Luna, wife of missing BNP leader M Ilias Ali, expressed optimism about getting back her husband alive after meeting the Prime Minister Sheikh Hasina on Wednesday.

“I am hopeful, pray for us,” Luna told reporters emerging from the meeting at the prime minister’s official residence Gono Bhaban in the capital.

Mahbubul Haque Shakil, the premier’s special assistant (press) said the PM has asked the law enforcement agencies to put highest effort to trace the missing BNP leader as soon as possible.

Earlier at about 6:30pm, Luna reached the Gono Bhaban along with her three children to meet the prime minister.

BNP Organising Secretary M Ilias Ali, 51, also a former lawmaker from Sylhet, and his driver Ansar Ali went missing from the capital's Banani area around midnight on April 17.

Saudi Executes 2 Bangladeshis

Saudi Arabia on Tuesday beheaded two Bangladeshis convicted of killing and robbing a fellow citizen in the kingdom, the interior ministry announced.

Nujum Abdulshrif and Abdulmajed Hamza killed Mohammed Kabir, also Bangladeshi; the state news agency SPA reported quoting the ministry.

They "suffocated him, beat him on his head using a thick stick, and strangled him" to death, the report said, adding they then stole Kabir's money and cell phones. The two men were beheaded in Jizan, in the kingdom's south.

The death penalty in Saudi Arabia applies to a wide range of offences including rape, apostasy, armed robbery and drug trafficking, as well as murder, as stipulated by Sharia law.
